You are correct. There is a rule in place against "ghost sieging" (or there was at least, with Funcom who knows), but it's applied to guilds who declare war and then never show up for the siege (or show up in ridiculously small numbers). In this case the force appears, starts a regular siege, then (I'm guessing, wasn't there so I don't know) once they realize there's no chance to win they just leave the map.
The fault, as always, is Funcom's. Sieges give no rewards whatsoever for participation, and who wants to get pummeled for 90 minutes to leave empty handed? Games are supposed to be fun, not a second job.
No rewards for losing + no mechanism to rebalance lopsided fights = people leaving early. Doesn't take a rocket scientist to understand...
